These License Terms (“License Terms”) govern your use of visual content available through AIvasovskiy (“AIvasovskiy”, “we”, “us”, or “our”), including photographs, illustrations, AI-generated images, and other visual assets available on aivasovskiy.com (the “Content”).
By purchasing, downloading, or otherwise obtaining Content from AIvasovskiy, you agree to be bound by these License Terms.
If you do not agree with these terms, you may not download, use, reproduce, or distribute the Content.

1. Our Licenses
AIvasovskiy offers two ways to license Content:
1. Individual Image License
You may purchase and license individual images from the AIvasovskiy gallery.
An Individual Image License grants you the right to use the specific Content you purchased in accordance with these License Terms.
2. All Gallery Subscription
A subscription provides access to the AIvasovskiy gallery for the duration of your active subscription.
During an active subscription, you may browse, download, and use Content according to the rights described in these License Terms.
Your subscription is a license to use the Content and does not transfer ownership of any Content to you.

2. Ownership of Content
All Content remains the property of AIvasovskiy or its respective licensors.
Purchasing or downloading Content does not transfer copyright, ownership, or intellectual property rights to you.
You receive a limited, non-exclusive, worldwide license to use the Content for the permitted purposes described in these License Terms.
You may not claim ownership of the Content or register it as your own intellectual property.

3. Individual Image License
When you purchase an individual image, you receive a license to use that specific image for personal or commercial purposes, subject to these License Terms.
Unless otherwise stated at the time of purchase, the license is:
* Worldwide
* Non-exclusive
* Perpetual
* Non-transferable
* Royalty-free after the applicable purchase has been completed
The license applies only to the image that you purchased.
You may use the licensed image in:
* Websites
* Mobile applications
* Social media
* Digital advertising
* Printed advertising
* Editorial publications
* Marketing materials
* Presentations
* Packaging
* Brand communications
* Commercial campaigns
* Internal business materials
* Other commercial or creative projects
You may modify, crop, resize, retouch, color-correct, or otherwise adapt the Content as reasonably necessary for your project.

4. All Gallery Subscription
An All Gallery Subscription provides access to the AIvasovskiy Content library for the duration of your active subscription.
During the subscription period, you may download and use Content for permitted personal or commercial projects in accordance with these License Terms.
The subscription does not grant ownership of the gallery or its Content.
Content downloaded during an active subscription
Unless otherwise stated in the applicable subscription plan, Content that you lawfully download while your subscription is active may continue to be used in projects created or published during the subscription period.
You may not use the subscription as a means to obtain a permanent copy of the entire AIvasovskiy library.

5. Subscription Restrictions
An All Gallery Subscription is intended for the individual subscriber or organization identified in the applicable subscription.
You may not:
* Share your account credentials with unauthorized users;
* Allow third parties to access the gallery through your account;
* Download Content on behalf of unrelated third parties;
* Use automated systems, bots, scripts, or scraping tools to download Content;
* Systematically download or archive the AIvasovskiy library;
* Create a competing image library using Content obtained through the subscription;
* Redistribute downloaded Content as stock, templates, or standalone assets.
AIvasovskiy may suspend or terminate an account if we reasonably believe that the subscription is being abused or used in violation of these License Terms.

6. Prohibited Uses
Regardless of the license type, you may not use Content:
As standalone stock content
You may not resell, sublicense, rent, lend, redistribute, or otherwise make Content available as standalone stock imagery.
You may not upload Content to another stock photography, image-generation, template, or content marketplace.
As a competing service
You may not use Content to create, train, populate, or operate a competing stock image library, image marketplace, or similar service.
As a trademark or logo
You may not use Content, or a substantial part of Content, as a trademark, service mark, logo, trade name, or other source identifier.
In unlawful or harmful contexts
You may not use Content in a way that:
* Violates applicable law;
* Promotes illegal activities;
* Is defamatory, fraudulent, or deceptive;
* Infringes the rights of others;
* Misrepresents a person, brand, organization, or event.

7. AI-Generated Content
Some Content available through AIvasovskiy may be created or assisted using generative artificial intelligence.
Unless expressly stated otherwise, the same license restrictions apply to AI-generated and non-AI-generated Content.
AIvasovskiy does not guarantee that every AI-generated image is eligible for copyright protection in every jurisdiction.
Your license gives you permission to use the Content under these License Terms; it does not guarantee that you will receive exclusive copyright protection or intellectual property rights in the underlying image.
You are responsible for determining whether a particular use of AI-generated Content is appropriate for your intended purpose and jurisdiction.

8. Model and Property Rights
Some Content may depict recognizable people, private property, locations, products, or other protected elements.
Where applicable, AIvasovskiy may identify Content as having model releases, property releases, or other relevant permissions.
Unless expressly stated otherwise, AIvasovskiy does not guarantee that a model release, property release, trademark clearance, or other third-party permission exists for every element depicted in the Content.
You are responsible for determining whether additional permissions are required for your particular use.
Content should not be used in a way that implies that a person shown in the Content endorses, sponsors, or is affiliated with your product, service, political position, or other commercial activity unless you have the appropriate rights and permissions.

9. Sensitive or Editorial Use
If Content depicts a recognizable person, you must not use it in a manner that could reasonably be considered defamatory, misleading, pornographic, discriminatory, or otherwise harmful.
You should not imply that a person depicted has a particular medical condition, criminal history, political affiliation, sexual orientation, or other sensitive characteristic unless the context is clearly fictional, illustrative, or editorial and legally appropriate.

10. Commercial Use
Commercial use is permitted under both license types unless a particular Content item or license explicitly states otherwise.
Commercial use includes advertising, marketing, branding, websites, social media campaigns, publications, product packaging, presentations, and other business-related applications.
Your license does not grant you the right to use AIvasovskiy trademarks, branding, logos, or other proprietary materials except where expressly permitted.

11. Client and Agency Use
If you are a creative agency, designer, freelancer, or other service provider, you may incorporate licensed Content into a project created for a client.
The client may use the resulting final work as part of that project.
However, you may not transfer the underlying Content itself to the client as a standalone asset unless the applicable license expressly permits such transfer.
A separate license may be required where the client intends to use the Content independently from the original project.

12. Downloads and Copies
You may create reasonable copies of licensed Content as necessary to produce and distribute your permitted work.
You may store licensed Content on your devices, servers, and project-management systems for legitimate project-related purposes.
You may not maintain an archive of Content for unrelated future projects where doing so would circumvent the applicable license or subscription.

13. Attribution
Unless otherwise stated, attribution is **not required** for commercial or personal use of licensed Content.
You may voluntarily credit AIvasovskiy, but you are not required to do so.

14. Exclusivity
All AIvasovskiy licenses are non-exclusive unless a separate written agreement states otherwise.
The same Content may therefore be licensed to other customers.
Purchasing an image does not give you exclusive rights to that image.
If you require exclusive use, please contact us to discuss a custom licensing agreement.

15. Subscription Renewal and Cancellation
Subscriptions automatically renew if automatic renewal is enabled at the time of purchase.
You may cancel your subscription according to the cancellation options provided by AIvasovskiy or the applicable payment provider.
Cancellation prevents future renewal but does not automatically revoke rights that were validly granted for Content already used in accordance with these License Terms, subject to the provisions of Section 16.

16. Effect of Subscription Expiration
When your All Gallery Subscription expires or is cancelled:
* Your access to the AIvasovskiy gallery ends;
* You may no longer download new Content under the subscription;
* You may no longer use the subscription to create new projects;
* Content already lawfully incorporated into completed projects during the active subscription period may continue to be used in those projects.
You may not begin a new project using previously downloaded Content after the subscription has ended unless you obtain a new license.
For clarity, an expired subscription does not require you to remove licensed Content from a completed campaign, published website, advertisement, or other project that was legitimately created during the active subscription period.

17. License Termination
If you materially breach these License Terms, your license may terminate automatically.
Upon termination, you must stop using the affected Content and, where reasonably possible, delete unused copies of the Content from your systems.
Termination does not affect rights that cannot legally be terminated or rights that have already been incorporated into completed projects where these License Terms expressly permit continued use.

18. Refunds
Purchases and subscriptions may be eligible for refunds in accordance with AIvasovskiy's applicable refund policy and mandatory consumer protection laws.
Because digital Content may be delivered immediately after purchase, certain digital purchases may not be refundable once access to or download of the Content has begun, where permitted by applicable law.
Nothing in these License Terms limits any mandatory consumer rights that cannot legally be excluded.

19. No Transfer of Rights
You may not assign, transfer, sublicense, or otherwise grant your license to another person or organization except as expressly permitted by these License Terms.
If your business is acquired, merged, or reorganized, the continued use of licensed Content may be permitted where the Content remains part of an existing project and the use remains consistent with the original license.

20. Intellectual Property Protection
You agree to respect all intellectual property rights associated with AIvasovskiy and its Content.

21. Disclaimer
AIvasovskiy provides Content on an “as available” basis.
To the maximum extent permitted by law, we do not guarantee that every item of Content will be suitable for every intended purpose or that the Content will be free from third-party rights or restrictions.
You are responsible for selecting Content appropriate for your intended use.
Nothing in these License Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.

22. Limitation of Liability
To the maximum extent permitted by applicable law, AIvasovskiy will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of licensed Content.
Nothing in these License Terms limits liability for matters that cannot legally be limited or excluded.

23. Changes to These License Terms
We may update these License Terms from time to time.
The updated version will be published on the Website with a revised “Last updated” date.
Changes will not retroactively reduce material rights that were validly granted to you under a previous license, unless required by law.

24. Governing Law
These License Terms are governed by the laws applicable to AIvasovskiy, except where mandatory consumer protection or other applicable laws provide otherwise.
Nothing in these License Terms limits rights that you may have under mandatory laws applicable in your country or state of residence.
